Jesse W. Markham, Jr., is senior counsel at Baker & Miller. He previously co-chaired the antitrust practices of Morrison & Foerster, and Orrick, Herrington & Sutcliffe. Mr. Markham served as deputy attorney general in Massachusetts and later in California. He is a past Chair of the California State Bar Antitrust & Unfair Competition Law Section. Mr. Markham is a recognized scholar, previously holding the Marshall P. Madison Professor of Law chair at the University of San Francisco Law School, which he left to take a visiting professorship at the University of California at Berkeley. He is widely published in the areas of antitrust law and corporate governance.
Mr. Markham has represented clients from around the globe in merger and non-merger agency proceedings, multi-district class action litigation and other complex civil cases, as well as criminal cartel grand jury proceedings. As a government attorney, he oversaw review of the then-largest bank merger in history. He has represented numerous defendants in complex antitrust litigation in various industries, including health care, pharmaceuticals, banking, paper products, airlines, agricultural cooperatives, insurance, electrical contracting, energy, and many others.
Mr. Markham has been active in assisting emerging market countries to draft, implement, and enforce competition laws, including China, Russia, Ukraine and Vietnam. Mr. Markham graduated from Harvard College and attended the Vanderbilt Law School, as well as Berkeley Law (Boalt Hall).
